Terms of Use

Any user of this site must first agree to the terms and conditions of this document before using this site in any manor other than viewing products. To buy and/or sell products, all users must first agree to these terms of use. By entering this site the user agrees to follow the terms outlined and realize that by using any portion of the site the user is legally bound by these terms.

The Handmade Artists' Shop is an online venue which allows the buying and selling of handmade goods. Handmade Artists' Shop provides a website only, where buyers and sellers can interact for the sole purpose of purchasing and selling handmade goods. The Handmade Artists' Shop is not directly involved with any transaction between the buyers and sellers and accepts no responsibility for such transactions.

Interactions between buyers and sellers are binding and must follow all local, national and international laws.

Age

All users of this site must be 18 years of age, or use only with express permission of a parent or guardian. Handmade Artists' Shop is a family friendly venue and does not allow mature content.

Vendor Rules

Vendors may access the site at the sole discretion of Handmade Artists' Shop. The vendor must be a paid subscriber on the Handmade Artists Shop and as a result of the paid subscription will have access to this site as a vendor. The Handmade Artists' Shop may cancel membership of any vendor at any time without notice and without refund. Handmade Artists' Shop is not liable to any user or any third party for the cancellation of your account.

In order to maintain your status as a vendor on the Handmade Artists' Shop you must keep your subscription current, if your subscription is not current your shop will not be visible after a 30 day grace period. If you choose to re-activate your subscription you will be able to do so from your vendor administration area. Your shop will then be reactivated and your existing products will be available for sale once again.

Handmade Artists' Shop is providing a marketplace venue for the vendors of this site to display and sell their handmade items. By listing products the vendor agrees that they have the legal right to sell their listed items. The vendor also agrees not to list any item that is not handmade by them. The vendor also agrees to not list the following:

Supplies which are not handmade by the seller
Mass produced items that are not handmade by the seller. This includes purchasing a premade/cast charm and putting it on a premade chain. This is assemblage, and not within our definition of handmade.
Items that are considered *destash* or leftover goods which they want to clean out. These include such items as left over craft supplies.
Hazardous or dangerous materials such as chemicals and/or weapons
Mature or adult materials; All listed products must be family friendly and safe for work
Any illegal or stolen goods
Alcohol, legal drugs, and/or illegal drugs
Any item that is against the law
Any item that you don't have rights to. (Handmade Artists assumes that the individual vendors have permission for use of copyrighted material. (Handmade Artists will be held harmless for an copyrighted material that a vendor chooses to sell wihout rights to sell the copyrighted material through fair use and permission from the copyright holder. Any and all claims for copyright infringement will be directed directly to the vendor themselves, and Handmade Artists' will be held harmless.) Handmade Artists will assist with any complaints from copyright holders against the vendors on this site, but will remain unharmed from any complaint.
Unaltered vintage items; vintage items will only be allowed if they are altered, transformed, or incorporated into new and unique creations

Vendors may list and sell as many items they choose provided that they have maintained their paid subscription on the Handmade Artists' Shop. There will not be any listing fees or commissions charged to the vendor at any time. If a vendor chooses to sign up to sell on The Handmade Artists' Shop, they agree that their shop may be removed at anytime if left empty.

Handmade Artist' Shop will not be involved in disputes between buyers and sellers. The Handmade Artists' Shop strongly suggests that the sellers clearly post their shop policies in their virtual storefront area. The vendor agrees to hold Handmade Artists' Shop harmless during any disputes that may arise.

By listing products for sale, the vendor agrees that the item is available for sale and will be shipped out within 1 week unless their policy states otherwise or other arrangements have been made between the buyer and seller. The seller also acknowledges that the quality of service that they provide to the customer directly effects the reputation of the venue and other artists. By the acceptance of these terms, agrees to provide the highest level of customer service possible.

By listing an item for sale the vendor is acknowledging that the product is as described and/or pictured. The vendor is acknowledging that the description and/or picture clearly represent to the buyer the characteristics of such product in order to create a clear understanding of the product.

All vendors' items must be listed in the appropriate category with the appropriate key words. If a vendor intentionally miscategorizes an item, that item will be removed at the discretion of The Handmade Artists' Shop.

The vendors' shop will be closed if the vendor neglects to maintain payments of their subscription to the Handmade Artists' Shop.

Transactions between Vendors and Customers

All transactions between customers and vendors are legally binding and are the sole responsibility of both parties to honor such contract.

Handmade Artists' Shop does not handle any monies that are exchanged between buyers and sellers. Handmade Artists' Shop provides a payment gateway through PayPal only, in order that customers may exchange monies with the vendor. Handmade Artists' Shop only allows transactions to take place on secure sites that are set up to handle the exchange of monies. Disputes that occur at any of these sites are to be handled with those parties involved. All users, customers and vendors alike, will hold the Handmade Artists' Shop harmless for any problems that may arise by such monetary transactions.

Warranties

Handmade Artists' Shop is not liable for any of the products that are listed and/or sold by the vendors.

Handmade Artists' shop is not responsible for any loss of potential sales due to the site being down for maintenance and or server error. The Handmade Artists' Shop agrees to make every effort to minimize such disturbances in service.

All users of this site acknowledge that they are using the site of their own free will and will hold the Handmade Artists' Shop harmless.

This agreement is intended to protect the Handmade Artists Shop from any potential legal issues and all users acknowledge this fact that by using this site of their own free will they will hold the Handmade Artists' Shop completely harmless of any and all legal claims. If there is a dispute that ends up in court, the dispute will be governed by the laws of the State of New Jersey. Any claim that does arise will be limited to the dollar amount of the original item that is in dispute and all users acknowledge that they will hold Handmade Artists' Shop harmless and settle all disputes with the respective seller and or customer involved.

Ownership of Site

The Handmade Artists' Shop is the sole owner of all aspects of this site including but not limited to Domain Names, Sub-Domains, themes, URL's and reserves the right to change any aspect of the site at any time without advanced notice. Handmade Artists' Shop and the Handmade Artists' Forum are divisions of Makin' The Best of It. Makin' the Best of It trading as Handmade Artists' Shop and trading as Handmade Artists' Forum will be held harmless. Where Handmade Artists' Shop is mentioned in this agreement it is understood that Makin' the Best of It and Handmade Artists' Forum will be covered by this agreement as well.
